These Terms of Service govern your use of [formandmora.com] and purchases made from Form & Mora.
By accessing our website, creating an account or placing an order, you agree to these Terms. Nothing in these Terms limits any mandatory rights available to consumers under applicable law.

In these Terms, “Form & Mora”, “we”, “us” and “our” refer to the company identified above. “Customer”, “you” and “your” refer to the person or business using the website or placing an order.
2. Eligibility
You must be at least 18 years old, or have the permission of a legal guardian, to place an order.
You must provide accurate, current and complete information when ordering. You are responsible for ensuring that your delivery address, contact information and payment details are correct.
We may refuse or cancel an order where we reasonably suspect fraud, unauthorised resale, misuse of the website or inaccurate customer information.
3. Products and availability
We aim to present our products as accurately as possible. However:

Colours may appear differently depending on the customer’s screen and lighting.

Natural materials may vary in colour, grain, texture, pattern and veining.

Handmade products may contain minor variations.
-
Product dimensions may vary slightly within normal manufacturing tolerances.
These natural or production-related variations are not normally defects.
All products are subject to availability. Adding a product to the cart does not reserve it.
We may discontinue products, limit quantities or change our collection without notice.
4. Prices and taxes
Prices are shown in the currency displayed on the website and include or exclude VAT as indicated at checkout.
Shipping charges, import duties, taxes and other applicable costs will be shown separately where possible.
Customers ordering outside the European Union may be responsible for import duties, local taxes, customs-clearance charges and related fees. Unless expressly stated otherwise, these charges are not included in the purchase price.
We may change prices at any time before an order is accepted.
If a product is listed with an obvious pricing, technical or descriptive error, we may correct the error and cancel the affected order. Where payment has already been taken, we will refund the amount paid.
5. Orders and contract formation
Submitting an order constitutes an offer to purchase the selected products.
An automated order confirmation acknowledges that we have received the order. It does not necessarily mean that we have accepted it.
The sales contract is formed when we:

Send a separate order-acceptance or dispatch confirmation;

Confirm that a made-to-order product has entered production; or
-
Otherwise expressly confirm acceptance of the order.
We reserve the right to decline an order before acceptance. Possible reasons include:

Product unavailability;
-
Incorrect pricing or product information;
-
Payment-authorisation failure;
-
Delivery restrictions;
-
Suspected fraud or misuse; or
-
An order quantity that appears intended for unauthorised commercial resale.
If we cannot accept an order after receiving payment, we will refund the amount paid.
6. Payment
Payment must be made using one of the methods offered at checkout.
The customer confirms that they are authorised to use the chosen payment method.
Payment services may be supplied by third-party providers. Their own terms and privacy practices may also apply.
For made-to-order, customised, specially sourced or business orders, full payment or a non-refundable deposit may be required before procurement or production begins.
Ownership of products remains with Form & Mora until full payment has been received, to the extent permitted by law.
7. Delivery
Delivery times are estimates unless we expressly agree to a binding delivery date.
Made-to-order and specially sourced products may have longer lead times. Any stated lead time generally begins after:

Payment has been received;

Specifications have been approved; and
-
Any necessary customer information has been provided.
Delays may occur due to production, supplier availability, customs, carrier disruption, weather, industrial action or other circumstances outside our reasonable control.
Under EU rules, goods must generally be delivered within 30 days unless a different delivery period has been agreed with the customer. (European Union)
The customer must ensure that:

The delivery address is correct and accessible;

Someone is available to receive the delivery where required;
-
Doorways, staircases, lifts and access routes are suitable for the product;
-
Any necessary parking, permits or building access have been arranged; and
-
The customer has checked the product dimensions before ordering.
Unless expressly included, delivery does not include assembly, installation, wall mounting, removal of packaging or removal of existing furniture.
Additional costs caused by an incorrect address, failed delivery, refused delivery, inaccessible premises or missed appointment may be charged to the customer where legally permitted.
8. Inspection on delivery
Please inspect the packaging and product as soon as reasonably possible after delivery.
Where packaging is visibly damaged, ask the carrier to record the damage on the delivery documentation. Where appropriate, refuse the delivery.
Damage should be reported to [email address] within 48 hours whenever reasonably possible, together with:

The order number;
-
Photographs of the product;
-
Close-up photographs of the damage;
-
Photographs of the packaging; and
-
A photograph of the shipping label.
The 48-hour reporting request helps us submit a transport claim and does not remove any mandatory statutory rights.
Keep all packaging until the matter has been resolved.
9. Returns and withdrawal rights
Returns are governed by our separate Return and Refund Policy, which forms part of these Terms.
Most EU consumers purchasing online have a statutory right to withdraw from an eligible purchase within 14 days of receiving the goods, without giving a reason. Certain exceptions apply, including goods made to the customer’s specifications or clearly personalised. (European Union)
Customers are responsible for return costs for change-of-mind returns where this has been clearly communicated before purchase. For bulky furniture, the estimated return cost should also be disclosed where the item cannot normally be returned by post. (European Union)
No additional voluntary return period is offered unless expressly stated.
10. Made-to-order and customised products
Products made, sourced or modified specifically for the customer may include:

Custom dimensions;
-
Customer-selected fabrics;
-
Special colours or finishes;
-
Personalised products;
-
Bespoke upholstery;
-
Specially commissioned products; and
-
Products ordered from a supplier specifically for the customer.
Once production, procurement or customisation has begun, these orders cannot ordinarily be changed or cancelled.
Where the statutory withdrawal exemption applies, made-to-order or clearly personalised products cannot be returned simply because the customer changes their mind. This does not affect rights relating to defective or incorrectly supplied goods.
The customer is responsible for reviewing and approving all specifications, dimensions, materials and finishes before production begins.
11. Defective or non-conforming products
Products must correspond with their description and meet applicable legal requirements.
Where a product is defective or does not conform to the contract, the available remedy may include:

Repair;
-
Replacement;
-
A proportionate price reduction; or
-
Refund, where appropriate.
Under EU consumer rules, repair or replacement must generally be provided without cost where goods are faulty or not as advertised. (European Union)
The following are not normally considered defects:

Natural variations in wood, stone, marble, leather or other materials;
-
Minor handmade or manufacturing variations;
-
Reasonable colour differences caused by screens or lighting;
-
Normal wear and tear;
-
Damage caused by incorrect assembly, use or maintenance;
-
Damage caused by unsuitable environmental conditions;
-
Damage occurring after delivery through mishandling; or
-
Dimensions that fall within stated or normal production tolerances.
Do not arrange repairs or return freight without our written approval. Reasonable unauthorised expenses may not be reimbursed.
12. Product care and assembly
Customers must follow all product-specific assembly, installation, use, maintenance and safety instructions.
Furniture should be assembled and installed by a competent person where appropriate.
Products requiring wall or ceiling attachment must be fixed using hardware suitable for the relevant structure. Unless expressly stated, Form & Mora does not assess the customer’s walls, ceilings, electrical systems or premises.
We are not responsible for damage caused by:

Incorrect assembly or installation;
-
Unsuitable fixings;
-
Failure to follow instructions;
-
Improper use;
-
Unauthorised alteration;
-
Inadequate maintenance; or
-
Use contrary to the product’s intended purpose.
This section does not exclude liability that cannot legally be excluded.
13. Business customers
A customer acts as a business customer where the purchase is made wholly or mainly for commercial, professional or organisational purposes.
Unless otherwise agreed in writing:

Business orders are final once accepted;
-
There is no change-of-mind return right;
-
Quotations are valid only for the period stated;
-
Delivery dates are estimates;
-
Deposits and payments relating to procurement or production are non-refundable;
-
Products must be inspected immediately upon delivery; and
-
Visible damage or shortages must be recorded with the carrier and reported promptly.
Mandatory consumer protections do not apply to purchases made as a business.
14. Website use
You may use the website only for lawful purposes.
You must not:

Attempt to gain unauthorised access to the website;
-
Introduce malware or harmful code;
-
Scrape or systematically extract website content;
-
Interfere with the website’s operation;
-
Submit false or misleading information;
-
Impersonate another person;
-
Use the website for fraudulent purposes;
-
Circumvent security or purchase restrictions; or
-
Use our content or product imagery without permission.
We may restrict or terminate access where these Terms are breached.
15. Intellectual property
All website content—including the Form & Mora name, logo, text, graphics, photographs, product presentation, layout and design—is owned by or licensed to Form & Mora and protected by applicable intellectual-property laws.
You may view the website and print limited content for personal, non-commercial use.
You may not reproduce, modify, distribute, publish, commercially exploit or create derivative works from our content without prior written permission.
Third-party brand names and trademarks remain the property of their respective owners.
16. Reviews and customer content
Where you submit a review, photograph, comment or other content, you confirm that:

The content is accurate and based on genuine experience;

You own it or have permission to submit it;
-
It does not infringe another person’s rights;
-
It is not unlawful, misleading, defamatory or offensive; and
-
It does not contain malicious code.
You grant Form & Mora a non-exclusive, worldwide, royalty-free right to display, reproduce and use the submitted content for operating and marketing the store, subject to applicable law.
We may moderate or remove content but are not required to publish every submission.
17. Third-party services and links
The website may contain links to, or integrations with, services operated by third parties, including Shopify, payment providers, logistics providers and social-media platforms.
We are not responsible for third-party websites, services or content outside our control.
Your use of third-party services may be governed by separate terms.
18. Promotions and discount codes
Promotions and discount codes:

Apply only during the stated promotional period;

Cannot be exchanged for cash;
-
May be limited to selected products or customers;
-
May not be combined unless expressly permitted;
-
May be withdrawn where used fraudulently or contrary to their terms; and
-
Do not apply retrospectively to completed orders.
Where a promotion contains an obvious error, we may correct or withdraw it before an order is accepted.
19. Limitation of liability
Nothing in these Terms excludes or limits liability for:

Death or personal injury caused by negligence;

Fraud or fraudulent misrepresentation;

Wilful misconduct;
-
Mandatory product liability;
-
Breach of mandatory consumer rights; or
-
Any other liability that cannot legally be excluded.
Subject to the above, Form & Mora is not responsible for indirect or consequential loss, loss of business, loss of profit, loss of opportunity or loss arising from circumstances outside our reasonable control.
For business customers, our aggregate liability relating to an order will not exceed the amount paid for the product giving rise to the claim, except where such a limitation is prohibited by law.
20. Events outside our control
We are not responsible for delay or failure caused by circumstances outside our reasonable control, including:

Natural disasters;

War or civil disturbance;
-
Strikes or industrial action;
-
Epidemics or public-health restrictions;
-
Transport or logistics disruption;
-
Customs delays;
-
Supplier or manufacturing interruption;
-
Power, telecommunications or internet failure; or
-
Government action.
We will take reasonable steps to minimise the effect of such events and contact affected customers where appropriate.
21. Privacy
Personal data is processed in accordance with our Privacy Policy.
The GDPR applies to organisations established in the EU and, in certain circumstances, to organisations outside the EU that target people located in the EU. (European Union)
22. Changes to these Terms
We may update these Terms to reflect changes to our business, services, technology or legal obligations.
The version applicable to an order is the version in effect when the order is placed, unless a change is required by law.
Material changes will be posted on the website with an updated revision date.
23. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.
The invalid provision will be interpreted or replaced as closely as legally possible to reflect its original purpose.
24. No waiver
If we delay or fail to enforce any provision, this does not waive our right to enforce it later.
25. Governing law and disputes
These Terms and purchases made through the website are governed by Finnish law.
For consumers residing in another country, this choice of law does not remove mandatory protections provided by the laws of their country of residence.
We encourage customers to contact us first so that we can try to resolve any issue directly.
Consumers residing in Finland may refer disputes to the Finnish Consumer Disputes Board after first contacting Finnish Consumer Advisory Services.
Any dispute not resolved amicably will be handled by the competent court determined under applicable law.
For business customers, disputes shall be subject to the exclusive jurisdiction of the District Court of [Helsinki], unless otherwise agreed in writing.
